Acceptance of terms

By accessing this website, placing an order, or purchasing from BA Liquidation, you agree to these Terms of Service and to our Refund, Shipping, and Privacy policies, which are incorporated here by reference. If you do not agree, please do not use the site or purchase from us.

Eligibility

You must be at least 18 years old and able to enter a binding contract to purchase from us.

Products and condition

• All items are sold AS-IS and may have cosmetic scratches or dents, which we disclose before purchase.
• Accessories such as cords, hoses, gas lines, and installation hardware are not included unless stated.
• Ice makers are not guaranteed on used or refurbished units.
• Product photos may be representative. The specific cosmetic condition of each unit is disclosed per item, and you may request exact photos before buying.
• It is your responsibility to review and understand the condition of each item before purchase. At checkout you must confirm, item by item, that you understand and accept the condition of each product. This acknowledgment is recorded with your order.

Pricing, payment, and taxes

Prices are in US dollars and are subject to change without notice. We make every effort to display accurate pricing and information, but errors can occur. We reserve the right to correct any error and to refuse or cancel any order affected by a pricing or description error, even after an order is submitted. Sales tax is the customer's responsibility where applicable. All deposits are non-refundable.

Orders

Your order is an offer to purchase. We reserve the right to accept, decline, limit, or cancel any order for any lawful reason, including suspected fraud, stock availability, or errors. If we cancel an order you have paid for, we will refund the amount charged for that order.

Pickup and storage

Pickup items must be collected within 3 days of purchase. A storage fee of $25 per day applies after that. Items left uncollected for an extended period may be treated as abandoned as permitted by law.

Intellectual property

All content on this website, including text, images, logos, and design, is the property of BA Liquidation or its licensors and is protected by law. You may not copy, reproduce, or reuse it without our written permission. Brand names, model names, and logos are the property of their respective owners.

Acceptable use

You agree not to use the site unlawfully, to interfere with its operation or security, to attempt unauthorized access, or to use it in any way that could harm BA Liquidation or others.

Disclaimer of warranties

Except for the limited warranty expressly stated in our Refund Policy or on a specific product, all appliances are sold AS-IS and WITH ALL FAULTS. To the fullest extent permitted by law, BA Liquidation disclaims all other warranties, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. The website and its content are provided "as is" and "as available" without warranty of any kind.

Limitation of liability

To the fullest extent permitted by law, BA Liquidation and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of use, data, or profits, arising out of or related to your purchase, the appliances, delivery, installation, the website, or these terms. Our total liability for any claim will not exceed the amount you paid for the specific product or service giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

Indemnification

You agree to indemnify and hold harmless BA Liquidation and its owners, employees, and contractors from any claims, damages, losses, or expenses, including reasonable attorney fees, arising out of your misuse of a product, your violation of these terms, or your violation of any law or the rights of another.

Governing law and disputes

These terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict of laws rules. You agree that any dispute will be resolved exclusively in the state or federal courts located in Prince William County, Virginia, and you consent to their jurisdiction, except where a dispute is subject to arbitration below.

Arbitration and class action waiver

To the extent permitted by law, any dispute that cannot be resolved informally will be settled by binding, individual arbitration rather than in court, except that either party may bring a claim in small claims court. You and BA Liquidation waive any right to a jury trial and agree that claims may be brought only in an individual capacity, and not as a plaintiff or class member in any class or representative action. If any part of this section is found unenforceable, the remainder still applies.

Force majeure

We are not responsible for any failure or delay caused by events beyond our reasonable control, including weather, natural disasters, supplier or carrier failures, labor issues, utility or network outages, or government actions.

Severability and entire agreement

If any provision of these terms is found invalid, the rest remain in full force. These terms, together with our other policies, are the entire agreement between you and BA Liquidation regarding your purchase and use of the site, and supersede any prior understanding.

Changes to these terms

We may update these terms at any time. The current version is always posted here with the effective date shown above. Your continued use of the site or a new purchase after changes means you accept the updated terms.
